A settlement has been reached in the class action lawsuit involving current and former Instacart Shoppers. If you are or were a Shopper at some point between September 1, 2017, and May 9, 2019, you may be entitled to receive a payment from the Settlement.

Your Legal Rights and Options in This Settlement
Submit a Claim and Receive a Payment

If you are a member of the Settlement Class, you must submit a Claim to receive a payment. Instructions on submitting a Claim are set forth in FAQ 6.

After final approval by the Court, the payment will be mailed to you at the address you include in your Claim. If your address changes, please notify the Claims Administrator as explained here.

As detailed on this website, being a member of the Settlement Class will release specified claims that you may have against Instacart.

Additionally, you will release FLSA claims that you may have against Instacart if you do not opt out of the Settlement Class.

The Claims Deadline is extended to May 1, 2020.

Exclude Yourself from the Settlement

If you do not want to be a member of the Settlement Class, you must exclude yourself by sending a letter to the Claims Administrator no later than November 14, 2019.

If you request exclusion from the Settlement Class, you will receive no money from the Settlement (even if you submit a Claim), but you will retain the ability to sue Instacart for the claims asserted in this lawsuit, in a different lawsuit, or in individual arbitration. See FAQ 7 for more information.

Object to the Settlement

If you want to object to the Settlement, you may write to the Court about why you do not like the Settlement.

Directions are provided in FAQ 8.

Do Nothing

If you do nothing, you will remain a member of the Settlement Class, but you will not receive a payment.
